Statement on the REACh Regulation
Dear Sir or Madam,
REACh differentiates between substances, preparations and articles. As a producer and supplier we deal with articles only. This concerns both raw material purchase and the sale of our ready-made products. With regards to articles, neither a pre-registration nor an approval is provided for under REACh.
Duties of producers, suppliers and importers of finished articles are stated in the REACh Regulation (EC) No.1907/2006 under Article 7 and Article 33.
Article 7 paragraph 1 indicates that a duty to register with the European Chemicals Agency (ECHA) arises if a relevant substance is present in articles in quantities totalling over 1 tonne per year and if, in addition, this substance is intended to be released under normal or reasonably foreseeable conditions of use. This case does not apply to articles produced by Triumph.
Article 33 regulates a supplier’s duty to inform recipients of articles and consumers. The duty to inform applies to articles containing substances causing high concern listed in Annex XIV, also called SVHC (substance of very high concern). If an article contains a substance listed in Annex XIV in a concentration of more than 0.1 % weight by weight, this duty on a supplier to provide information applies.
Since October 28, 2008 there are first proposals published from the ECHA regarding substances to be included in Annex XIV. To our current state of knowledge our articles do not contain any SVHC in a concentration exceeding 0.1 % weight by weight. Therefore, it is considered that we are not affected by the duty to supply information as per the REACh Regulation.
As the production and supply of non-irritant products have always been and always will be an important feature for TRIUMPH, we do not expect that REACh will result in any considerable changes. However, if relevant findings for our products should occur within the scope of implementing the REACh Regulation, we will take them into account in the interest of the optimization of our articles.
