(1)The court held that although "Mini World" and "Minecraft" do not constitute substantial similarities in the overall picture, the two games have similarities in the design of game elements. However, the scope of copyright protection does not include the design of game elements at the level of gameplay rules, so the similarity of game elements cannot be directly inferred that the game pictures constitute substantial similarities. Therefore, the court did not support Netease's claim for copyright infringement.
(2)The court also found that "Mini World" and "Minecraft" are highly similar in terms of playing rules and overlap in the details of game elements, which exceeds the boundaries of reasonable reference. By copying the design of game elements, mini-play companies directly capture the key and core personalized commercial value of other people's intellectual achievements, constituting unfair competition.
2. Determination of liability for stopping infringement and amount of compensation
(1)After comprehensively considering factors such as the characteristics of sandbox games, the proportion of infringing content, and the possibility of rectification, the court did not support Netease's petition to stop operating "Mini World". Instead, it ordered Mini Play Company to delete the 230 game elements infringed by "Mini World".
(2)In terms of determining the amount of compensation, the court held that the mini-game company, as the infringing party, should have access to relevant data on operating income, but refused to provide it to the court without justifiable reasons, and should bear the presumption of unfavorable.
